Contracts

Remember when your hand shake was your bond? Your word was as good as gold? What has happened to this country with regard to these moral standards? They are gone. Some say it is the lawyers that created the problems today with all the lawsuits. Some say it is greed. People only care about money. Dirty, old, money.

Whatever the cause in todays world you need a contract. It can be as simple as a page or two. They teach you in contracts law in law school that you need to have four things in every contract:

  • Subject matter, that means what is the contract about. It is the sale of a car, a sale of business or for employment? The contract needs to state what the contract pertains to.
  • The second thing every contract needs to have is, whether in Reno, Nevada or New York, it has to state a price. The amount to be paid or given.
  • The third thing every contract must have is a statement of time. Is this contact for 2 years or it is to happen now? Time, if not stated, is assumed to be a reasonable time under the circumstances.
  • The forth requirement is that a contract should name the parties. Joe is selling his car to Mary. There names should be listed as seller and buyer in the body of the contract.

So if contacts are so simple then why do we see these multiple page contracts? Well these are known as the contract terms. That is where the attorneys come in. Will there be a clause for attorney fees if the contract is breached? Will there be a clause for arbitration and if so is the arbitration clause specific enough to be enforceable?
